These Terms govern your access to and use of privateartauction.com and related services, operated by Private Art Auction. By creating an account, bidding, purchasing, or listing artwork, you agree to these Terms.

1. Eligibility —

   Must be 18+ and able to form a binding contract.

2. Accounts —

   You’re responsible for your credentials and all account activity; notify us of unauthorized use immediately.

3. Buyer Terms —

   Bidding & Auctions — Auctions run on a fixed countdown; the highest valid bid at close wins. Placing a bid is a binding commitment to purchase if you win. Some auctions are “Private Auctions” for registered, eligible collectors only. Winning bidders must complete payment within the stated timeframe. Failure to pay may result in account suspension and forfeiture of bidding privileges.

4. All Sales Are Final —

   ALL SALES MADE THROUGH PRIVATE ART AUCTION ARE FINAL. By bidding or purchasing, you acknowledge that purchases are non-refundable and non-returnable except where required by law. Buyers should review listings carefully before bidding. A checkbox confirming acceptance must be checked before purchase completion.

5. Seller (Artist) Terms —

   Must complete verification before listing. Artist Subscription: $10/month to maintain an active listing profile. Auction Participation Fee: $5 per listing. Artists warrant that they are the original creator/rightful owner and that the work doesn’t infringe third-party IP. Featured/sponsorship placements offered at our discretion, with separate terms if applicable. Artists are responsible for accurate listing descriptions.

6. Fees & Payments —

   Processed via our secure third-party processor; fees are non-refundable except as required by law or stated otherwise.

7. Shipping & Delivery —

   Unless stated otherwise, the artist or our fulfillment partner ships to the winning bidder after payment confirmation; timeframes provided at checkout or in listing details.

8. Intellectual Property —

   Site content, design, and branding are owned by or licensed to Private Art Auction. Artists retain ownership of their own artwork, subject to a non-exclusive, royalty-free license granted to us to display, reproduce, and promote images of listed work on the Site and in marketing.

9. Prohibited Conduct —

   Listing counterfeit, stolen, or misrepresented artwork · Bid manipulation, including shill bidding or bidding on your own listings · Unlawful use of the Site · Circumventing auction fees via off-platform sales initiated through the Site · Uploading infringing content.

10. Disclaimers —

    Site and Services provided “as is”/”as available.” We don’t guarantee artwork authenticity, value, or condition beyond our verification steps; buyers should conduct their own due diligence.

11. Limitation of Liability —

    To the fullest extent permitted by law, we’re not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including buyer-artist disputes.

12. Termination —

    We may suspend or terminate accounts for Terms violations, fraud, or misuse.

13. Governing Law —

    Governed by the laws of US.

14. Changes to These Terms —

    Continued use after updates constitutes acceptance.
